Conditions of participation for the draw of GOLDEN FUN TICKET
FUN FACTORY GmbH, Am Hohentorshafen 17-19, 28297 Bremen (hereinafter “FUN FACTORY”), is carrying out the competition “Golden Fun Ticket”, to which the following conditions of participation apply:
1. Participation
a) These conditions apply to participation in the competition GOLDEN FUN TICKET from FUN FACTORY GmbH. By purchasing a SUNDAZE toy the purchaser will take part in the competition. No additional costs will be incurred through participation, it is voluntary and without any obligations for participants.
b) All adults who acquire a SUNDAZE toy at one of the following participating companies are entitled to take part. Employees of FUN FACTORY GmbH and their relatives are excluded from participation.
c) How can someone take part in the competition?
People can take part in the competition by buying a SUNDAZE toy from one of the participating companies during the campaign period detailed below.
The participating companies are:
For Lovehoney Ltd (United Kingdom) the campaign period is from November 16th, 2020 to January 16th, 2021.
For Atlas Trade Ltd (Russia) the campaign period is from January 1st, 2021 to February 14th 2021.
c) How can someone take part in the competition?
People can take part in the competition by buying a SUNDAZE toy from one of the participating companies during the campaign period detailed below.

- Atlas (Russia)
- intimshop.ru (Russia)
- Himerus Importadora e Distribuidora (Brasil)
For Lovehoney Ltd (United Kingdom) the campaign period is from November 16th, 2020 to January 16th, 2021.
For Atlas Trade Ltd (Russia) the campaign period is from January 1st, 2021 to February 14th 2021.
For intimshop.ru (Russia) the campaign period is from January 1st, 2021 to February 14th 2021.
For Himerus Importadora e Distribuidora (Brasil) the campaign period is from January 1st, 2021 to June 12th 2021.
e) The object of the competition is 5 GOLDEN SUNDAZE SETS in total.

- cleaning cloth
2. Conduct and settlement of the competition
a) With the purchase of a SUNDAZE toy the purchaser takes part and has the chance to win a set of GOLDENEN SUNDAZE. There is one GOLDEN FUN TICKET in five SUNDAZE packages in total. By receiving a GOLDEN FUN TICKET, the participant will win one set.
b) As soon as a participant has received a GOLDEN FUN TICKET, they must inform FUN FACTORY to receive their prize. To do this, the winner can send an email to the following email address: goldenfunticket@funfactory.com by providing proof of purchase from the retailer and their GOLDEN FUN TICKET. This must be done within the official campaign period.
FUN FACTORY GmbH or one of the participating companies will then send the prize to the address given by the winner by post free of charge.
c) If the winner does not inform FUN FACTORY within one month of the end of the campaign, the claim to the prize will lapse and no new winner will be identified. The same applies if the prize cannot be delivered by post.
d) Neither a cash payment of the prize nor an exchange for other merchandise or vouchers from FUN FACTORY are possible. The prize is non-transferable.
e) If a participant informs FUN FACTORY that they have received a GOLDEN FUN TICKET, the participant accepts the conditions of participation.
f) FUN FACTORY is entitled at any time and without prior announcement and without disclosing grounds prematurely to end, adjust or amend the competition, if the orderly conduct of the competition cannot be guaranteed for technical or legal grounds without appropriate measures.
3. Data protection
Under data protection law, FUN FACTORY GmbH is responsible for processing personal data for the purposes of organising the competition.
If you do win, we will request your name, address, email address and telephone number. We require your email address so that we can confirm you have won and can communicate with you. Further, we will store the name and address data as well as your telephone number to settle the competition and may pass this to third parties, who act on our behalf. These third parties are postal services and companies participating in the campaign. The data thus passed on may only be used by the recipient to fulfil its task. No other use of the information is permitted. Third parties to which the data is forwarded for data processing purposes are also subject to the provisions of data protection law and are contractually obliged to confidentiality.

Data processing will be carried out at your request exclusively for the purpose of settling the competition and shipping. The legal basis for this data processing is Art. 6 (1) sentence 1 b) GDPR.
After the competition has been settled, your data will generally be erased within 90 days. If a participant is a customer of FUN FACTORY or if they subscribe to the newsletter, or they do this within 60 days of participation, their data will continue to be stored as long as this is necessary for the contractual relationship or they continue to subscribe to the newsletter.
If FUN FACTORY processes your personal data, you as a data subject have the data subject rights detailed in our general Privacy Policy under the conditions of data protection law (right to information, right to rectification, right to erasure, right to restrict processing; right to be informed, right to data portability, right to object; right to withdraw a declaration of consent under data protection law, right to complain to a supervisory authority). This Privacy Policy also includes disclosures about the supervisory authority responsible for us and the company Data Protection Officer we have appointed.
4. Other provisions
a) FUN FACTORY cannot accept any liability for losses of data, in particular during the course of data transmission and for other technical defects.
b) The organisers’ decision is final.
c) The exclusively applicable law is the law of the Federal Republic of Germany. This choice of laws only applies to consumers insofar as the protection granted is not withdrawn by mandatory provisions of the law of the state in which the consumer is ordinarily resident.
d) Should any of these provisions be or become ineffective, this shall not affect the validity of the remaining conditions of participation.
e) These conditions of participation may be changed by FUN FACTORY at any time without any separate notification.
If FUN FACTORY processes your personal data, you as a data subject have the data subject rights detailed in our general Privacy Policy under the conditions of data protection law (right to information, right to rectification, right to erasure, right to restrict processing; right to be informed, right to data portability, right to object; right to withdraw a declaration of consent under data protection law, right to complain to a supervisory authority). This Privacy Policy also includes disclosures about the supervisory authority responsible for us and the company Data Protection Officer we have appointed.

f) The FUN FACOTRY does not guarantee for material and/or legal defects of the respective winnings. The exclusion of the above liability for material defects and / or defects of title of FUN FACTORY does not apply if the defect in law or the defect in the item was fraudulently concealed. Warranty claims regarding the originally purchased SUNDAZE toys are not affected by the exclusion of warranty.
